End User License Agreement

License terms for using the Mio application.

This End User License Agreement ("Agreement") is between you and Novikov German Oleg, IE (DUNS: 933896802), located at Sayat Nova 19/1, Yerevan, Armenia ("Licensor") and governs your use of the Mio application ("App").

By downloading or using the App, you agree to these terms. This Agreement complies with Apple's standard EULA requirements.

1. License Grant

The Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.

2. Scope of License

You may not distribute or make the App available over a network where it could be used by multiple devices at the same time.
You may not rent, lease, lend, sell, redistribute, or sublicense the App.
You may not copy, decompile, reverse-engineer, disassemble, or attempt to derive the source code of the App.
You may not modify, adapt, or create derivative works of the App.

3. Consent to Use of Data

You agree that the Licensor may collect and use technical and usage data as described in the Privacy Policy. This data is used to improve the App and provide services, including the AI Assistant feature.

4. AI Assistant

The AI Assistant feature provides informational content based on general pediatric guidelines. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The Licensor assumes no responsibility for actions taken based on AI responses. Always consult a healthcare professional for medical decisions.

5. Subscriptions

The App offers auto-renewing subscriptions (Mio Plus) managed through Apple In-App Purchases. Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. Manage subscriptions in your Apple ID settings.

6. Third-Party Services

The App integrates with third-party services (Supabase, OpenAI, RevenueCat, Amplitude). Your use of the App is also subject to their respective terms and privacy policies. The Licensor is not responsible for third-party service availability or practices.

7. No Warranty

The App is provided "as is" without warranty of any kind. The Licensor disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

In no event shall the Licensor be liable for any indirect, incidental, special, consequential, or punitive damages. The Licensor's total liability shall not exceed the amount paid by you for the App in the preceding 12 months.

The Licensor is not liable for any health outcomes related to the use of the AI Assistant or tracking features.

9. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and destroy all copies.

10. Governing Law

This Agreement shall be governed by the laws of the Republic of Armenia.
